LEVENTH CIRCUIT VICTORY IN FALUN GONG CASE - On January 12, 2009, the Eleventh Circuit granted our Petition for Review on a case where the BIA denied our customer's motion to reopen to allow her to apply for asylum based on changed circumstances in China. Our customer's asylum application was denied in 2001. Subsequently she began practicing Falun Gong in the US. We filed a Motion to Reopen with the Board of Immigration Appeals arguing that her case should be reopened located on a change of country conditions in China with respect to the treatment of Falun Gong practitioners. We argued that Chinese Government increased its enforcement of its prohibition against the practice of Falun Gong in China since 2001.
