read moreIf your fianc is not a U.S. citizen but is only a lawful permanent resident he or she should consult with us to see if he qualifies to become a U.S. citizen. The overall denial rate (for all fiance visas filed in the United States by all individuals filing fiance visa cases) in the beginning of 2019 is 50%. The denial rate was less than 10% a couple of years ago. In contrast almost 100% of our fiance visa cases have been approved. The unmarried children, under the age of 21, whether or not they are the biological children of the United States citizen, may be eligible to accompany you into the United States and apply for their own green cards.
I-751
read moreAn I-751 is used to remove the conditions on your green card. If you were married to a United States Citizen for less than 2 years on the day you received your green card then the green card that you received was, as they say, conditional. In order to make your green card a permanent green card you have to remove the conditions on it. USCIS does not fully trust marriages which were less than 2 years old at the time of the granting of the green card and makes the green card holder prove that they are still married in order to receive a permanent green card.

Fiance Visa Processing Time 2020
read moreThere are several factors that influence how long a given fiance visa case will take. These include overall case filings, which country your fiance resides in, and whether the case has been prepared properly. For many years, for most people, the total time it would take to make it through the USCIS stage, the National Visa Center Stage and the embassy stage was between 5-9 months. However, during the Trump administration the total time to process a fiance visa case was longer. Most properly filed fiance visa cases were making it through all 3 stages in the 8 to 10 month range.
Fiance Visa Interview Most Important
read moreIn 2019 fiance visa cases are taking about 10 months to complete. This is the time period needed to go through all 3 stages of the fiance visa process. We have had cases that have gone through all 3 stages in less than 10 months this year but those are outliers. At the end of the fiance visa process you will have your fiance visa interview at the embassy or consulate. The interview should take 10 to 30 minutes to complete. This varies from place to place and case to case. In another article I went over the fiance visa questions you should be prepared to answer during the fiance visa interview.
Fiance Visa and Form I-944
read moreAs a result many people who could filed their adjustment of status cases prior to February 24, 2020. Our office, as well as the offices of many of my colleagues, was extra busy during this time period. The good news is that you do not need to file the I-944 form as part of the fiance visa process. It is not required at any point during the process. If you are filing for a marriage green card there is a new similar form to be filed in those cases. However, for the fiance visa it is not required.
